Use of the Geartech Midlands website and any products and services supplied to you by Geartech Midlands Ltd constitutes your acceptance of these terms and conditions with immediate effect. Geartech Midlands Ltd reserves the right to change these terms and conditions at any time and will post changes on this page.

Contracting parties and contact information

By placing an order you will be entering into a legally binding contract with Geartech Midlands Ltd for the supply or our products and services. Our Registered in England number is: 02894768. order acceptance

Once you have accepted our quotation via telephone, email or other digital channel a contract will come into existence between you and Geartech Midlands Ltd. If we are unable to accept your order, we will inform you of this immediately. This may happen if the product you require is out of stock or because of unexpected limits on our resources.

We retain the right to refuse to accept your order solely at our discretion. If there is concern that there is an attempt to place an order dishonestly, fraudulently, by impersonating someone else or by attempting to use a vehicle or payment details which have been stolen, we will make additional checks and if appropriate and will involve external authorities.

Free collection and delivery

We collect loose gearboxes, differentials and transfer units only. We do not collect, recover or deliver vehicles. Our designated areas of free collection and delivery are throughout the counties of Worcestershire, Warwickshire, Herefordshire and Gloucestershire only. Customers outside of these UK counties are be required to make their own collection and delivery arrangements. Acceptance of deliveries at Geartech Midlands Ltd can only be guaranteed by prior agreement and within the business hours stated on this website only.

We will endeavour to collect and deliver on a pre-arranged day with the customer. Traffic and other considerations that are outside of our control may affect the time and accuracy of the collection and delivery arrangements.

If we are unable to provide your service we may recommend an alternative supplier, however Geartech Midlands hold no responsibility for the products or services provided by any other business.

Geartech Midlands Ltd hold no responsibility for work carried out on the customer’s vehicle by any third-party suppliers unless the works were exclusively sub-contracted by Geartech Midlands Ltd.

Products and replacement parts

Geartech Midlands Ltd always fit OE parts where available. Where necessary we may use aftermarket products of an equivalent or improved quality. We reserve the right to refuse to fit parts supplied or suggested the customer. Any product guarantees are subject to the product suppliers terms and conditions, no further warranty or guarantee is offered.

Liabilities and responsibilities

Geartech Midlands Ltd remove and fit gearboxes, differentials and transfer units on our own premises by our trained technicians. We hold no responsibility for damage to the vehicle or mechanical failures outside of the works described on our supplied quotation.

Once the product has been supplied, you will become liable for any loss or damage to the product unless such loss or damage was caused by Geartech Midlands Ltd.

With the exception of warranty and service exchange parts, removed parts will be disposed of by Geartech Midlands Ltd. Disposal will be in accordance with current environmental regulations and legislative requirements. A fee may be charged for this service.

Vehicles presented for test drive diagnosis or repair must be delivered with adequate fuel to enable us to complete the necessary tests. The customer agrees to additional charges to cover fuel and labour and time implications in the event of a vehicle presented with low fuel levels.

Geartech (Midlands) Ltd hold Employers’ Liability Insurance to the value of £5M.

Payment and ownership

Payment in full is required on completion of the work. No credit or extended payment period is offered.

All products supplied remain the property of Geartech Midlands Ltd until paid for in full although this retention of ownership will not affect any claim which we may have against you for the payment of any overdue amount.

Guarantee

You will receive a guarantee certificate outlining our responsibility for the work completed. The guarantee applies from the date of payment. This guarantee is non-transferable and applies to the customer’s name listed on the supplied certificate only. The presentation of the final invoice and the supplied certificate must be provided before work can be carried out under the guarantee. The guarantee does not affect your statutory rights.

In the event of the product becoming defective during the guarantee period, you should immediately inform Geartech Midlands Ltd. You must provide written details of the type of product, purchase date and the nature of the problem and include the original certificate.

The guarantee does not cover towing or recovery charges, loss of earnings or any other consequential loss, other than in the event of death or injury to the customer. No liability is accepted in respect of consequential loss or damage however caused. No liability is accepted in respect of additional costs or expenses incurred by a buyer or user arising directly, or indirectly, from any defect, breakage or failure that is due to circumstances beyond Geartech Midlands Ltd’s control.

Additional charges

Storage charges will be payable to Geartech Midlands Ltd in relation to any abandoned vehicles or vehicles not collected for a period of 30 days following completion of the work undertaken by Geartech Midlands Ltd.

We reserve the right to charge a reasonable additional amount to cover any unavoidable, or irrecoverable costs and/or expenses incurred by Geartech Midlands as a direct result of a customer’s action outside of these terms and conditions.

Complaints procedure

If you have a complaint or are not satisfied with the service or product you have received from Geartech Midlands Ltd, please contact us directly using the contact details provided above. You must afford us a reasonable opportunity to remedy the problem and you must take reasonable steps to minimise or avoid any loss or damage which may arise.
